The slab right is one of the new real rights that were included after the promulgation of the Civil Code of 2002. It was created by Provisional Measure No. 759/2016, which was transformed by the National Congress into Law No. 13,465 / 2017. The slab arises from the precarious urbanization that occurred in Brazil, and the creation of this new real right comes as a way of adapting the right to the Brazilian urban reality. The new modality provides for a series of new rules on the preemptive right in the event of alienation of the slab after its constitution, focusing on civil and procedural legislation, without prejudice to the preference rules already provided for in the Brazilian legal system. A preference order is also created, where some figures of the slab’s legal system will have priority over others. The preference comes as a way to avoid conflicts between the owner of the slab and the other residents of the construction, since, historically, the slab is built, in most cases, in a family context.||O direito de laje é um dos novos direitos reais que foram inclusos após a promulgação do Código Civil de 2002. Criado pela Medida Provisória nº 759/2016 foi transformada pelo Congresso Nacional na Lei nº 13.465/2017. A laje nasce da urbanização precária ocorrida no Brasil, e a criação deste novo direito real vem como forma de adequação do direito à realidade urbana brasileira. A nova modalidade prevê uma série de regras ao direito de preferência na ocorrência de alienação da laje após a sua constituição, incidindo sobre a legislação civil e processual civil, sem prejuízo das regras de preferências já previstas no ordenamento jurídico brasileiro. É criado também uma ordem de preferência, onde algumas figuras do sistema jurídico da laje terão prioridade sobre outras. A preferência vem como forma de evitar conflitos entre o titular da laje e os demais moradores da construção, já que, historicamente, a laje é construída, na maioria das vezes, em um contexto familiar.
