This paper explores the relation between landscape protection and the spirit of the place, especially the challenges for this protection to be effective. Thus, this analysis focuses on the landscape protection by heritage advisory bodies, the challenges in fulfilling the intended protection and the need for a management agreement between all nations involved with the territory for it to be considered heritage, a sine qua non condition for the effective preservation of a difficult thing: the spirit of the place.||Este texto contempla as relações entre a proteção da paisagem e o espírito do lugar, em particular os desafios para que essa proteção possa ser efetiva. Assim, a análise trata do histórico da proteção pelos órgãos envolvidos com o patrimônio, das dificuldades de fazer valer a proteção pretendida e da necessidade de um pacto de gestão com todos os envolvidos no território que se quer patrimonializar, condição sine qua non para a efetividade da preservação de algo que é desafiador: o espírito do lugar.
