O alargamento da atuação política do judiciário provoca a desefcacização dos valores constitucionais, afetando a estabilidade democrática no apogeu dos setenta anos da Declaração Universal dos Direitos Humanos. O ideário construído a partir da Constituição Federal de 1988, em busca da consolidação de um Estado Democrático de Direito, desvela o sentimento do período pós-ditatorial em restabelecer uma sociedade livre, justa, igualitária e fraterna, aos moldes preconizados pela DUDH de 1948. O poder soberano do Estado, alicerçado na atuação independente e harmônica dos Poderes Executivo, Legislativo e Judiciário, aliado ao restabelecimento de um regime de Direito, demonstra a intenção do constituinte conformar um novo cenário democrático. A preferência pelos desígnios de determinados grupos, em detrimento dos interesses de todos, desvirtua o poder estatal, desajustado em suas funções executivas, legislativas e judiciárias. O judiciário, alma mater na garantia dos direitos fundamentais, como ente integrante do poder político uno do Estado, desnatura-se ante sua preocupação puramente política. Para referendar a análise, utilizou-se da fenomenologia-hermenêutica heideggeriana, assentada na pesquisa bibliográfca e documental.||The extension of judicial policy leads to a defnition of constitutional values, a democratic situation that is not at the height of the years of the Universal Declaration of Human Rights. The ideology of the Federal Constitution of 1988, in search of the consolidation of a Democratic State of Right, reveals the feeling of a post-dictatorial division in restoring a free, just, egalitarian and fraternal society, as advocated by the UDHR of 1948. Sovereignty of the State, based on its function and harmonious in its executive, legislative and judicial powers, is also a right to a democratic regime. The chance by groups of certain groups, to the detriment of the interests of all, distorts the state power, mismatched in its executive, legislative and judicial functions. The judiciary, the alma mater in the fundamental guarantee, as the member of the political power of the State, is denatured in the face of its purely political concern. To refer an analysis, use the heideggerian hermeneutic phenomenology, based on bibliographical and documentary research.
