In this research, we discuss the theme of school's institutional prejudice in relation to the student's usual and daily linguistic variety, especially focusing on discourse about the linguistic prejudice as a way of scholastic violence that affects the fundamental principle of human dignity of the students. Therefore, were mobilized the normative institutes concerning to item 1 of article 2 of the Universal Declaration of Human Rights, the item three of article 1º of the 1988 Federal Constitution and article 210 of the same constitutional charter. In addition, we discussed ideas from following theorical bases: Bittar (2009), Campuzano (2008), Canclini (2013), Candau (2007, 2011), Freire (2020), Rojo (2009, 2013, 2012) Street (2014), among other pertinent bibliographies. The choice of these juridical and theoretical terms was done in reason of they could refracted points of view that base fundamental rights, the guaranties of them by the State, and the way the school should establish the mother language teaching focusing on the respect of the student’s linguistic-identity. Methodologically, the work is grounded on the technics of the bibliographic research. As a result, we realized that school violence is related to the prejudiced treatment mode that the institution demonstrates at teaching's process of Portuguese Language; and that this violence affects the dignity of the human person when disregards the linguistic variety and the historical, ideological, axiological, cultural, economical features, and others.||Nesta pesquisa, discutimos o preconceito linguístico da escola concernente à variedade linguística do aluno, sobretudo enfocando nesse preconceito como uma forma de violência que fere o princípio da dignidade da pessoa humana do/a/s alun/o/a/s. Para verificar isso, foram mobilizados o item 1 do artigo 2 da Declaração Universal dos Direitos Humanos, o Inciso III, do Artigo 1º da Constituição Federal de 1988 e o artigo 210 dessa carta constitucional. Ademais, foram pensadas ideias oriundas das seguintes bases teóricas: Bagno (2007), Bittar (2009), Campuzano (2008), Canclini (2013), Candau (2007, 2011) Freire (2020), Rojo (2008, 2009, 2012), Street (2014), dentre outras bibliografias pertinentes. A escolha desses elementos jurídicos e teóricos justifica-se em razão de, neles eles, refratarem-se pontos de vista que fundamentam a discussão de direitos fundamentais, de como esses direitos devem ser garantidos pelo Estado e de como a escola deve pensar o ensino de língua materna levando em consideração o respeito à constituição linguístico-identitária do aluno. Metodologicamente, a pesquisa é de caráter bibliográfico. Como resultado, constamos que a violência escolar diz respeito ao modo de tratamento preconceituoso que a instituição demonstra no processo de ensino da língua portuguesa, e que essa violência afeta a dignidade da pessoa humana do aluno, quando desconsidera a variedade linguística e os traços históricos, ideológicos, axiológicos, culturais, econômicos, dentre outros.
