In the intention to promote rights expressed in the constitutional charter, the Judiciary, more precisely the Federal Supreme Court, before the omission of the other powers, acts in a haughty way in order to respond to society the yearnings for all the guarantees given by the Greater Law. Embodying the function of Guardian of the Constitution, the STF seeks to concretize constitutional precepts, sometimes extrapolating its typical function. The purpose of the present work is to analyze Judicial Activism in the face of the position of the Supreme Court, based on a form of interpretation, which is the expansive hermeneutics.||Na intenção de promover direitos expressos na carta constitucional, o Poder Judiciário, mais precisamente o Supremo Tribunal Federal, ante a omissão dos outros poderes, atua de forma altiva no sentido de responder à sociedade os anseios por todas as garantias entregues pela Lei Maior. Empossado na função de Guardião da Constituição, o STF busca a concretização dos preceitos constitucionais, extrapolando, por vezes, sua função típica. O presente trabalho tem por fnalidade analisar o Ativismo Judicial diante do posicionamento da Suprema Corte, embasada em uma forma de interpretação, que é a hermenêutica expansiva.
